Capita Data Breach - Class Action
 

I contacted Barings Law (Solicitor firm in Manchester) who advised me they were acting for several individuals who had been affected by the Capita Data Breach. 

This is the latest update from Barings ...

"We have been pursuing this matter on behalf of more than 4,000 clients and have taken the necessary steps to present a compelling case. We previously sent an extensive Letter of Claim (LOC) outlining our clients’ claim to Capita. However, Capita has denied liability in this matter.

Despite Capita’s denial, we are fully committed to pursuing this claim to the fullest extent of the law. To this end, we have retained a leading Kings Counsel to assist in building and presenting a strong case. Our goal is to move this case forward towards issuing court proceedings in the High Court. We anticipate that the claim will be issued within the next 2 to 4 weeks.

If you have submitted your evidence and received a confirmation email of completion, please note that we will not be contacting claimants individually until we have a further update on the claim. (Message from Pat Brady, Chair APPA)

Dear Pensioner,

I promised to keep you up to date regarding the Capita data breach which occurred in March 2023. You will have received a letter dated 30th May 2023 from AXA Group Pension scheme notifying you that your personal data was taken from Capita as part of a cyber incident.

Since receipt of the notifications, several AXA UK Group Pension Scheme members have contacted the AXA Provincial pensioners Association to indicate that they are greatly concerned about this incident and have asked us for further details about the breach or if we can provide additional support or assistance to alleviate their concerns.

As a result, we have explored several options and have been made aware that a few Legal Companies have begun to initiate a Class Action lawsuit against Capita, specifically relating to the data breach and the impact it is having on the lives of those affected.

Class Action, otherwise known as Group Litigation, is the collective legal action brought about by a group of claimants that have been similarly affected by an occurrence in the same way, whether it be negligence, or other cause. The Capita data breach affecting AXA pension members is a good illustration where Class Action claims can be genuinely made.

The purpose of this letter is to advise you that members of AXA UK Group Pension Scheme (from the AXA Provincial Pensioners Association) have met with one of the Legal Firms, Barings, involved in the Class Action lawsuit against Capita to better understand the implications of taking this potential course of action and what alternatives are available for any AXA claimants should they decide to participate in the litigation.

If you have been advised by AXA UK Group Pension Scheme that your personal information has been affected by the Capita data breach, you are now presented with two options:

  1. Take no further action and continue monitoring any suspicious activity by using the 12-month free Experian services that we provided with the notification letter
  2. Explore the option of Class Action against Capita with Barings Law. This could result in you receiving a financial award (compensation) if there is a successful outcome. Barings operate on a no win, no fee basis and have advised us there will be no cost to the individual.

If you opt to explore the option of becoming involved in the Class Action against Capita, you will need to provide proof of your notification letter confirming you have been personally affected.  This is the letter you received dated 30th May which I refer to in my first paragraph.
